Teaching About Legal and Ethical Issues

Slide 2:  Hello, I am __________. Today’s topic of the presentation is to discuss the ethical and logical issues of the students, or faculty members that are badly impacting the academic setting along with the integrity of the staff (Dib et al., 2020). The students and staff should be aware of rules and regulations regarding any practice in the academic year to prevent them from any misbehavior which will violate the policies of the institutions. As a lead instructor for the medical nursing course to second-year students in the ADN program, it is my responsibility to keep a check on ethical violations both from the student end or from the instructor end to maintain the decorum of the academic setting and the dignity of the institute. This presentation will identify the change in behavior regarding ethical and legal issues and the resource information that will be used to implement a change. In this presentation, the culturally sensitive issues will also be discussed and action plans will be made to integrate continuous improvement and evaluation of learning about the legal and ethical issues. 

Legal or Ethical Issues: Clinical Education Issues

Slide 3:  As a lead instructor for the second-year student Sharon of the ADN program I have observed that the instructor of the student only provided one feedback in the five-week clinical rotation and she improved the changes that are suggested. The clinical instructor thinks Sharon will fail in the rotation because she claims she didn’t receive frequent feedback for further improvement. She will appeal if she fails and the issue here is whether it is due to lack of feedback or ineffective evaluation. However, the lead instructor now observes and evaluates Sharon in her final rotation and will provide the instructor and student with proper guidance. The ineffective evaluation and delay in feedback in clinical education raises the issues of ethical and legal concerns involving transparency and fairness of the instructor in evaluating the student (Jamshidian et al., 2019).

Necessary Changes in Behavior

Slide 4: To address the ethical and legal issues effectively the instructor should be responsible for providing frequent, timely, and regular feedback to the students to guide them further in their improvement in the specific course and help them achieve high grades (Marquez et al., 2023). The feedback needs to be clear and accurate so that can assess the student during her improvement for the next clinical rotation. The evaluation process and tool need to be standard to validate the fairness and consistency of the evaluation. The communication with the students should be effective and honest so they can openly share their concerns with the instructor and get efficient feedback. Students also need to stay active during the evaluation process and should be motivated enough to assess their results. Training and Mentoring programs should be provided to the instructor to integrate effective evaluation strategies in the teaching practice for better outcomes for the students. 

Change Management Approach

Slide 5: The change in behavior of the student, instructor, and leadership is necessary to give students the impression of being treated fairly while creating a sense of accountability in the teachers and the leaders for their teaching practices and student concern dealing policies (Zheng, 2022). To implement the changes in behavior effectively Kotter’s 8-Step Change Management Model will be used which has the following factors;

  • Share and communicate the urgency for change in behavior regarding legal and ethical practices of the instructors and the leadership.
  • The collaboration of all the members is necessary to understand the need for change and the identification of effective evaluation practices.
  • Establish a strategy that will be based on regular evaluation of the students using standardized evaluation tools, and proficient training workshops for the instructors. 
  • Use different platforms to communicate the need for change with all the stakeholders.
  • Integrate the provision of effective resources to the instructors to improve the process of evaluation. 
  • Implement and evaluate the change in milestones starting from 2-3 clinical rotations feedback improvement. 
  • Regularly evaluate the feedback of the change strategy to implement new suggestions. 

Resource Information Synthesis

Slide 6: To effectively address the issues regarding delays in evaluation in a case study of Sharon it is essential to identify the resources that will help in implementing the change management approaches efficiently and ensure the sustainability of the results (Naidoo, 2023). The adequate resources will help in determining the areas of practice and knowledge gaps to proficiently plan and develop strategies that can address these areas. A few resources are given below;

  • The policies of the institution regarding the evaluation process should be based on standardized criteria that will be helpful for the instructors and the leaders in creating documented and well-defined feedback.
  • All the stakeholders should be aware of the procedures of appeal from the students including the paperwork or period. 
  • Implement guidelines regarding the evaluation process provided by the nursing organization and accrediting agencies to effectively monitor the impact of evaluations. 
  • Professional development workshops and training programs should be introduced in the facility to help the instructors implement evaluation strategies that are of great benefit to the students in their teaching practices.
  •  Standardized evaluation tools including digital platforms of feedback can be used in the teaching practice to generate error-free evaluation results. 
  • Student mentoring and self-assessment guidance should be made part of teaching to help them understand the idea of self-management.
  • Integration of legal expert’s opinions in the evaluation process can increase the efficiency of the results.

Knowledge Gaps

Slide 7: Proper identification of knowledge gaps in the implementation of evaluation strategies and determination of resources is necessary (Powell et al., 2019). The consistency in the provision of feedback can not be determined unless proper data about the efficiency of the monitoring of feedback is not collected. There is a gap of knowledge for the instructors in accurately understanding the ethical and legal policies. The effectiveness of the current tools of evaluation can not be determined exactly which creates an uncertainty in the evaluation results. The student’s feedback about the evaluation helps the instructor in identifying the gaps in the practice and changes needed to fill these gaps. There is a gap in the identification of the effect of teachers’ feedback on the students.

Teaching Presentation on Legal and Ethical Issues

Slide 8: The teaching presentation was designed to identify the ethical and legal issues in the case of Sharon and how the implementation of a change management approach can effectively handle the issues (Phillips & Klein, 2022). After the identification, the communication about the desired change should be done accurately and transparently for better understanding. Integration of change management evaluation elements and methods is necessary to analyze the improvement required in the plan. A few procedures of the teaching presentation are given below;

Identification of Legal or Ethical Issues

The issue in the case of Sharon was the ineffective evaluation of the clinical instructor along with the infrequent and delayed feedback. This will lead to the failure of Sharon in clinical rotation whereas she is good in his theoretical portion. The ethical issue relates to the fact that an instructor’s inefficiency can create problems for the students and they can appeal which results in legal issues. Timely and effective addressing of the legal and ethical issues in the clinical education setting is necessary to ensure the quality of education provided to the students along with maintaining the integrity of the staff and the dignity of the institution. 

The Desired Change

By implementing standardized evaluation tools and techniques the fairness, transparency, and accuracy of the feedback can be validated along with the satisfaction of the students with the process of evaluation. Proper training and workshops should be provided to the instructor to understand the effective integration of standardized evaluation tools in the teaching practice and the regular provision of feedback. 

Change Management Strategy

The change management approach is needed to implement the change behavior effectively and improve students’ feedback about the evaluation strategy. The Kotters 8-step model will be effective in implementing, monitoring, and evaluating the change in the behavior of students, staff, and leaders. 

Elements and Methods to Facilitate and Measure Change

Slide 9: Introduce the training sessions for the faculty and the clinical instructor to understand the effectiveness of accurate feedback and evaluation process on the progress of the student in an academic career (Burgess et al., 2020). Implement orientation sessions for students also to make them understand the criteria of feedback and evaluation proficiently. Digital and standardized tools should be used by the instructors to ensure the accuracy of the evaluation feedback provided to the student without delay using the fast transmission efficiency of digital evaluation platforms. Clinical instructors should be engaged in mentorship programs with the experts to identify the key areas and gaps in practice and develop strategies to improve those areas. 

Steps to Evaluate the Improvement

Slide 10: The effectiveness of the implementation of any change model can be clearly understood by continuously and regularly reviewing the outcomes and monitoring the feedback generated from the change model (Barrow et al., 2022). The opinion regarding the change can be obtained from both the students and the teaching staff to identify the areas of knowledge and practice gap and to ensure the effectiveness of the strategies in removing those particular gaps from the practice. The model should be flexible so that any new strategies can be effectively implemented in the system without impacting others.

Culturally Sensitive Issues

 Slide 11: The most important issue regarding cultural sensitivity is the language barrier between the students and the faculty. As education has become the most necessary of all the people around the world, the diversity of the students increases as they travel from one place to another in the seek of the best knowledge and information (Alam & Mohanty, 2023). It is the responsibility of the institution to address the hindrances in the provision of effective information to the students by providing communication channels that are proficient for meeting the diversity of the students. Effective communication is clear, plain, and understandable to all hence by using simple language the students will be able to clearly understand the concerns of the institution for better performance.

Students must be provided with both written instructions and verbal feedback for improved comprehension of the instructions given by the clinical instructor. Facilitate the students by providing translation facilities for their better results. Moreover, the feedback should be culturally competent that do not make any student feel less or rude from the instructor’s perspective. Biases in the evaluation can harm the students and will decrease the performance of students regarding a particular course or topic (Daskalopoulou, 2024). The instructor should treat all the students equally and effectively to give them the impression that all are equally valued and their concerns are effectively considered.

Learning styles should need to be culturally competent as some students prefer groupings and some prefer individual work therefore the teaching methods should be effective enough to incorporate different teaching styles suitable for all the students (Cabual, 2021). The policies of the institution need to be culturally observant as people have different religious beliefs and occasions and that needs to be considered in a curriculum for the enhanced participation of students in the studies. The instructor’s behavior or the course curriculum should not support discrimination among the students as it will create a negative classroom environment and divide the students into groups. 

Actional Plans for Continuous Learning

 Slide 12: An action plan for continuous learning should be based on regular learning practices and the involvement of the clinical instructors, students, and leaders in effectively monitoring the learning workshops and evaluating the information gained from the training programs (Stalmeijer et al., 2022). A few factors for the successful implementation of the action plan are given as follows;

  • The clinical institution should be engaged in ongoing education including workshops, webinars, and training programs.
  • Keeping the institution updated with all the recent research journals based on the practices that are in alignment with ethical and legal laws. 
  • Professional development goals are necessary and important for the growth of the instructor in effectively delivering the information to the students. 
  • Online educational courses should be introduced to create ease for the instructors and ensure the majority participation. 
  • Joining legal committees and regularly assessing oneself regarding ethical and legal guidance is necessary for the effectiveness of the action plan. 
  • The institutional policies need to be updated and in compliance with the regulatory organizations.

Slide 13: Staying updated on the legal evolutions and improvement in the standards to better identify the needs of today’s time. The environment of the institution should be culturally effective addressing the perspective of all the students. The feedback systems need to be updated and enhanced to generate effective and accurate outcomes. Involve student’s opinions regarding feedback to identify the knowledge gaps and improvement areas.

Slide 14: The legal and ethical issues in an institution are of great concern for the students, instructors, and leadership (Dib et al., 2020). In the case study of Sharon, she faces the chances of failure due to ineffective, infrequent, and delayed feedback response from the clinical instructor which creates a hindrance in her way of improving her lackings ultimately resulting in fear of failure. The changes in behavior are necessary to effectively communicate the concerns of the student and provide feedback that is more accurate, timely, and efficient in providing proper guidance to the student. Appropriate resources are required for a successful change in behavior by using the change management model. Culturally sensitive issues and the action plan should be in alignment to proficiently understand the cultural concerns and perspectives of the student and consider them while designing and implementing the plan of action.
